This Privacy Policy governs and lays down the way XSEED Education PTE LTD or XSEED Education Private Limited or any of its related entity (hereinafter also referred as ‘XSEED’ or the ‘Company’ or ‘We’, collectively referred as ‘XSEED Group’) collects, uses, maintains, and discloses information collected from users (together ‘Users’ and each a ‘User’ or ‘you’ or ‘Your’) of the store or any of its platform(s). This Privacy Policy applies to all the Platform(s) of XSEED and all the services offered by XSEED on this Platform. The terms of this Privacy Policy form part of and should be read in conjunction with the XSEED Terms of Service which govern the sale of the products on this Platform and Conditions of Use of this platform.

Personal identifiable information

We collect Personal Identifiable Information about you from a variety of sources. We collect information from you directly (e.g. when you contact us or create an account with us), automatically (e.g., data collected via cookies and similar technologies), and from other sources, including commercially available sources, such as public databases. For example, we collect, process, and use your Personal Information when you:

  • register with XSEED or on a XSEED application/platform
  • log into an account
  • interact with the XSEED Services
  • order products or content from us
  • attend an event or conference
  • share information in response to XSEED’s request via any means including phone call, email etc.
  • use XSEED’s platform(s) 
  • use XSEED’s Services to access electronic content or
  • contact us for customer care, etc.

 

Non-personally identifiable information

We may collect non-personally identifiable information about Users whenever they interact with our platform(s). Amongst others, non-personal identifiable information may include the browser name, the type of computer and technical information about users’, means of connection to our platform, such as the operating system and the internet service providers utilized and other similar information.

Our Platform(s) may use ‘cookies’ to enhance Users’ experience. Cookies are alphanumeric identifiers that We transfer to User(s) computer to enable our systems to recognise your browser and to provide customised suggestions, recommendations and features, such as ‘Recommended for you’ etc. The Help menu on the menu bar of some browsers may tell you how to prevent accepting new cookies, how to have the browser notify you when you receive a new cookie and how to disable cookies altogether. XSEED may collect and use Users’ personal information for the purposes which shall also include:

  • Marketing including personalised advertising and re-marketing
  • To analyse User data/Users’ activity

How We protect your information

We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal identifiable information, username, password, transaction information and data stored on our Platform(s). However, “perfect security” does not exist on the internet. You therefore agree that any security breaches beyond the control of our standard security procedures are at your sole risk and discretion.

We do not sell, trade, or rent Users’ personal identifiable information to others. We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and users with our business partners, trusted affiliates and advertisers for the purposes outlined above. Because the internet is a global environment, you accept and agree that this will include the transfer of your personal information to other countries around the world.   • with third-party search engines (including e.g. that index user profile pages and usernames as part of the URL of the user profile page by default)

  • with other third parties with your consent

User Rights

Parents and Legal guardians

We encourage parents, guardians and teachers to be with children (under 18 years of age) when children engage in the on-line activities on our platform(s). We will never request Personally Identifiable Information from a child in any of our public posting areas. No Personally Identifiable Information of children should be submitted to or posted on our Platform(s) by children without the consent of their parent or legal guardian. We encourage parents to help us protect their children’s privacy by instructing them never to provide Personally Identifiable Information on our platform(s) or any other platform without parental permission. Parents and Legal guardians acknowledge and agree that it is their sole responsibility to control and review the access and information sharing by children on our platform(s). 

 

The minimum age to use our platform(s) is 18 (eighteen) years. By using the platform(s) and in order to be competent to contract under applicable law, You represent and warrant that You are at least 18 (eighteen) years of age or not a minor in any other jurisdiction from where you access the platform(s). If you are directly subscribing to our any XSEED platform(s), You represent and warrant that You are at least 18 years of age and that You possess the legal right and capacity to use the services of XSEED in accordance with the stated terms and usage policies. In cases, where a minor below the age of 18 years of age, wants to use XSEED’s platform(s), such a user shall duly register himself through his parents and natural/legal guardian and such parent and legal/natural guardian hereby agree to accordingly register and supervise usage by, and be responsible for the action of any such minors who use the computer and/or password to access the XSEED’s platform(s). It is deemed that, the parent and legal/natural guardian enter into this agreement on behalf of such minor and bind himself/herself in accordance with all terms and conditions herein.

 

Children 

Please do not give your photograph, full name, email address, home address, telephone number or any other Personally Identifiable Information that would enable someone to contact you either on-line or off-line, without first asking your parent or guardian for permission.

 

We may disclose a Child’s Personally Identifiable Information if we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) our rights or property, other users, or anyone else that could be harmed by such activities. We may also disclose a Child’s Personally Identifiable Information when we believe in good faith that the law requires it. 

 

XSEED reserves the right to monitor your use of the platform(s) to determine if you are complying with our terms and the right, in its sole discretion, to terminate your access to the platform(s).

At XSEED’s sole discretion, We may update this Privacy Policy at any time and as many times as may be required. We encourage Users to frequently check this page for any changes to stay informed about how We are using and helping to protect the personal information We collect. You acknowledge and agree that it is Your responsibility to review this Privacy Policy periodically and become aware of modifications. Further, when a User makes a public posting [in a group or community on any XSEED Platform(s)] of any comment or media, it’s considered public information, and the respective User is liable for any intellectual property or copyright infringement or any other liability/consequence with respect to the same. We expressly state that XSEED shall not be liable for any consequence with respect to any public posting by any User(s).

 

Trademarks, authors’ rights, and database rights

All content included on the platform(s), such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of XSEED, its affiliates or its content suppliers and is protected by applicable intellectual property laws.

You may not systematically extract/ or re-utilise parts of the contents of the platform without XSEED express written consent. In particular, you may not utilise any data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) for re-utilisation of any substantial parts of this platform, without XSEED’s express written consent. XSEED’s trademarks and trade address may not be used in connection with any product or service that is not XSEED’s, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits XSEED.

 

Obtaining Additional Information about Privacy

If you have any concerns or questions about privacy on XSEED’s Platform(s), please contact our customer support for your grievances at the contact and mail address mentioned at our platform(s).

 

Retention of  the data

XSEED plans to retain user data while an account is active and for at least three years afterward. XSEED may alter this practice according to legal and business requirements. For example, XSEED may lengthen the retention period for some data if needed to comply with law or voluntary codes of conduct. Unless otherwise prohibited, XSEED may shorten the retention period for some types of data if needed to free up storage space. We keep information for as long as We need it, comply with legal obligations or to protect our or other’s interests. We decide how long We need information on a case-by-case basis.

 

How can you access or control your information

If you have an account with XSEED, you can review and update your personal information by opening and editing your profile details, You are solely liable and responsible for any information you provide.

 

Indemnity

You shall indemnify and hold harmless XSEED, its officers, directors, contractors or agents and any third parties relying on the Information provided by You for any losses, including all claims, damages, liabilities, deficiencies, assessments, interest, awards, settlements, penalties, fines, costs or expenses, suffered, incurred, sustained by, or imposed on the XSEED (including any of its related parties), as a result of, arising out of, with respect to, in connection with or by reason of a breach or non-performance of any of the terms, conditions, representations or warranties contained in this Privacy Policy by You.

 

Force Majeure

A Force Majeure Event shall mean any event that is beyond the reasonable control of XSEED and shall include but not limited to war, riots, fire, flood, acts of God, explosion, strikes, lockouts, slowdowns, prolonged shortage of energy supplies, pandemic, computer hacking, unauthorized access to computer data and storage devices, computer crashes ,acts of state or governmental action prohibiting or impeding XSEED Entities from performing its respective obligations under the contract.


Agreement shall be subject to jurisdiction of the Courts of Delhi, India.


You further agree that such collection, use, storage, disclosure and/or transfer of Your Information shall not cause any loss to any other person. The information so provided by You may be shared to XSEED Group Entities and the third-party service provided on a need to know basis.

This disclosure may be required for us to provide you access to our Services, to comply with our legal obligations, to enforce our User Agreement, to facilitate our marketing and advertising activities, or to prevent, detect, mitigate, and investigate fraudulent or illegal activities related to our Services. We do not disclose your personal information to third parties for their marketing and advertising purposes.

 

B. NO OBJECTION /CONSENT

Parents and Legal guardians

The respective school’s principal/management of my ward’s school may allow XSEED the permission/ consent to develop/ capture/ record/ use certain materials including images and video recordings of and in school premises; demo classes, online classes, training sessions etc. which includes Personal Information of students like name, age, photographs, audio recordings, video recordings depicting presence of teachers/ staff as well as students (hereinafter referred to as “Proposed Works”) for the purpose of XSEED’S training content, webinars, marketing content, promotional material, advertisements, social media account or any other online/digital platform or print etc. (hereinafter referred to as “the Purpose”).

 

My ward has participated/ shall participate in development/ creation of Proposed Works for the Purpose defined above. 

 

I hereby with my free will give my consent and authorization on worldwide basis to XSEED including its parent entity, their fellow subsidiaries, affiliates and distributors to the use of Proposed Works. 

 

Further, I confirm that I do not have an objection to XSEED including its parent entity, their fellow subsidiaries, affiliates and distributors in having exclusive IP rights with respect to the said Proposed Works. 

 

I, being the legal guardian of my ward and on his/ her behalf, confirm that my ward shall not object to XSEED using the said Proposed Works for the Purpose stated above and shall not claim royalty on the same after attaining the age of majority.

 

Teachers

The respective school’s principal/management may allow XSEED permission/ consent to develop/ capture/ record/ use certain materials including images and video recordings of and in our school premises; interviews of teachers/ staff, demo classes, online classes, training sessions etc. which includes Personal Information of teachers/ staff like name, age, profession, designation, photographs, audio recordings, video recordings depicting presence of teachers/ staff as well as students (hereinafter referred to as “Proposed Works”) for the purpose of XSEED’S training content, webinars, marketing content, promotional material, advertisements, social media account or any other online/digital platform or print etc. (hereinafter referred to as “the Purpose”).

 

I with my free will and consent agree to participate in development/ creation of Proposed Works for the Purpose defined above. I hereby with my free will give my consent and authorization on worldwide basis to XSEED including its parent entity, their fellow subsidiaries, affiliates and distributors to the use of Proposed Works which includes my Personal Information for the Purpose.

 

Further, I confirm that I do not have an objection to XSEED including its parent entity, their fellow subsidiaries, affiliates and distributors in having exclusive IP rights with respect to the said Proposed Works. 

 

The authorization and consent granted herein shall continue to be indefinitely bound even after the termination/completion of my employment/engagement with the aforementioned School.
